4. Public hearing to consider entering into an Agreement for Private Development, and to consider conveyance of certain city-owned real estate to Cedar Falls Partners, LLC. This would transfer city land to the applicant at no charge, and provide 5 years of scaled tax abatements, in order to support the applicant's construction of a $8.5M distribution center in the southern industrial park.

5. Pass Ordinance #3038, amending Chapter 23, Traffic and Motor Vehicles, of the Code of Ordinances relative to establishing temporary long-term daily permits for municipal parking lots or facilities, upon its third & final consideration. This was discussed in previous meetings. If approved on this reading, it will be added to the city code of ordinances.
6. Resolution approving and adopting an amendment to the FY24 Fee Schedule relative to establishing temporary long-term daily parking permits for the municipal parking lots or facilities. (contingent upon approval of the previous item) If item 5 passes, then this amendment will add the $3 per day permit to our fee schedule.
7. Pass Ordinance #3040, amending Chapter 23, Traffic and Motor Vehicles, of the Code of Ordinances relative to establishing a 4-way stop at the intersection of Center Street & Lone Tree Road, upon its third & final consideration. This has been discussed in previous meetings; if approved in this reading, then it will be officially in the city code and the two new stop signs will be erected on Center Street.
8. Pass Ordinance #3041, amending Chapter 26, Zoning, of the Code of Ordinances relative to parking requirements for institutional uses in the Downtown Character District (CD-DT), upon its second consideration. (requires 5 aye votes) This was discussed in a previous meeting, and would enable St. Patrick Catholic Church to build a parking lot without also needing to put up a two-story building on that lot, per the existing city code.
9. Pass Ordinance #3042, amending Chapter 2, Administration, of the Code of Ordinances relative to establishing a Bicycle and Pedestrian Commission, upon its second consideration. This is largely an administrative change, but would allow the mayor and council to appoint and confirm members to that body.
10. Pass Ordinance #3043, amending Chapter 23, Traffic and Motor Vehicles, of the Code of Ordinances relative to prohibiting parking on certain portions of Dakota Street, upon its second consideration. This was discussed in previous meetings, and was amended from 90 minutes to 2 hours at the previous council meeting.

13. Approve an Order Accepting Acknowledgement/Settlement Agreement with The Music Station, Inc., a/k/a Mini Mart, 1420 West 1st Street, for a second tobacco violation. This would assess this convenience store owner with a $1500 penalty for a second violation of selling tobacco products to a minor.
14. Approve the following applications for retail alcohol licenses: The City Council is the approving authority for all alcohol permits and liquor licenses.

16. Resolution approving and authorizing the Transfer of Funds from the General Fund to the Health Insurance Fund and Capital Projects Fund relative to the fiscal year ending June 30, 2023. Each year, the city typically has money remaining from the previous year's budget. This year, 2.2M remained, largely due to turnover and staff vacancies. If the council approves this resolution, the unspent funds will be applied toward health insurance claims due to several large claims and high premiums. It would also be targeted, as planned, for helping to fund Cedar Falls' part of the High School Pool, the new Pickleball Courts, and the River Recreation Project.
17. Resolution approving and authorizing execution of an Amendment to Owner's Statement and Deed of Dedication of West Viking Road Industrial Park Phase V. This is a straightforward legal change to allow the use of storage containers in the industrial park under certain conditions. It doesn't affect any existing agreements, but makes things simpler for future agreements.
18. Resolution approving and authorizing execution of an Amendment to Owner's Statement and Deed of Dedication of West Viking Road Industrial Park Phase VI. Same as #17.
19. Resolution approving and authorizing execution of an Agreement to Enhance Economic Development in Cedar Falls by Supporting Grow Cedar Valley relative to an FY2024 Economic Development Grant. This is our annual agreement to support Grow Cedar Valley (the area chamber of commerce) at $30K for this year, with an option for up to $32K in additional incentive payments based on agreed-upon criteria and goals.
20. Resolution approving and authorizing execution of First Amendment to the Agreement for Rotary Plaza with The Rotary Club of Cedar Falls relative to additional lighting for the Rotary Plaza being constructed at 205-221 West 1st Street. (not recommended by staff) This is interesting; Rotary Club wants to install lighting for the new memorial that Rotary Club is placing on West First Street, but city staff is recommending that the city not pay for the monthly electric bill for that lighting, becuase it doesn't do so for other lighting projects. Ultimately, it's the council's decision. I'll be interested to learn what the projected annual cost might be for this, as it will be low-cost LED lighting. The other examples provided in the memo are temporary installations like Holiday Lights, so I can see how this kind of installation on city property might be different.
21. Resolution approving and authorizing execution of a Cultural Leadership Partners Program Operating Support Grant Agreement with the Iowa Economic Development Authority (IEDA) relative to Hearst Center cultural programs and operating expenses. This is a $10K grant from the state with no local match required. It just needs Council approval so that I can sign the agreement on behalf of the city.
22. Resolution approving and authorizing execution of a Memorandum of Agreement with the University of Northern Iowa (UNI) relative to fiberglass statues for the Panthers on Parade Project. This gives the city the right to use the TC mascot likeness as part of our project to put 25 mascot sculptures around the community as a visible show of support to UNI and our college student residents.

Resolution approving and authorizing execution of an Agreement with Peters Construction Corporation for transporting, finishing and installing fiberglass statues relative to the Panthers on Parade Project. This would allow the contractor to set up the statues in #22 above, paid for with sponsor dollars (not taxpayer dollars).
24. Resolution approving and authorizing execution of a HIPAA Business Associate Agreement with Wellworks For You relative to the City’s employee wellness program. This allows Wellworks to retain city employee HIPAA information multi-year, to help employees track their health trends long term.
25. Resolution approving and authorizing execution of an Agreement with Cedar Falls Police Protective Association for Installation of Plaques Honoring Reserve Officer Scott Sterrett relative to memorial markers along South Prairie Lakes Trail. This agreement would allow the CFPPA to proceed with pillars along the trail in honor of Officer Sterrett. All associated costs would be borne by the CFPPA, not taxpayers.
26. Resolution approving and authorizing execution of an Agreement with Breanna Parker relative to providing hula hoop fitness classes at the Recreation Center. This is a standard agreement where the city receives 20% of registration fees and the fitness instructor receives 80%.
27. Resolution approving and authorizing execution of an Agreement with Spahn & Rose Lumber Co. relative to construction of a new shelter in Orchard Hill Park. This would proviede $30K for the contractor to build a shelter at the Pickleball Courts at Orchard Hill Park, as approved in the FY2024 CIP (CFD 3203.24)
28. Resolution approving an amendment to The Arbors Master Plan, to allow some lots designated for bi-attached dwellings to be changed to single family lots. This would allow lots in this new construction area to accomodate multiple housing types, and was unanimously recommended by the P&Z Commission.
29. Resolution approving the amended preliminary plat for The Arbors Fifth, Sixth, and Seventh Addition. (contingent upon approval of the previous item) Same as #28 above.
30. Resolution approving the Certificate of Completion and accepting the work of Owen Contracting, Inc. for the 2022 Alley Reconstruction Project, and approving and authorizing the transfer of funds from the Storm Water Bond Fund to the Street Construction Fund. This allows the contractor to be paid the remaining $26.6K for this project's completion.
31. Resolution approving and authorizing execution of a License Agreement with Windstream Intellectual Property Services, LLC relative to installing a fiber optic telecommunications system within the public right-of-way along Main Street. This allows the applicant to install fiber optic in the Cedar Falls public right of way for a nominal fee.
32. Resolution setting September 18, 2023 as the date of public hearing to consider conveyance of certain city-owned real estate to KATZ Properties, LLC. This simply sets the hearing date.
