Annotated Agenda for July 19, 2021

In the Monday night Council Meeting, the Council will consider a 5% tax abatement for the 2119 College Street Project (Item #4), approval of a contract to design the Main Street reconstruction (Item #20), and several sidewalk infill projects, permeable alley projects, and Public Works equipment acquisitions.  The remainder of the agenda is largely administrative in nature. 

Prior to that, at our 5:20 Work Session we'll discuss drainage in Northern Cedar Falls, and then hold a joint meeting with the Human Rights Commission to discuss the status of HRC initiatives for 2021 and other important topics.

Special Presentations

2. Recognition of Health Trust Fund Board Members Rosemary Beach and Floyd Winter. Rosemary and Floyd are exiting public service to the city after decades and decades of excellent service to the City and people of Cedar Falls.  Currently Staff and I are working on a more robust and clear awards process (including the near-mythical Key to the City).   In the meantime, I want to ensure Rosemary and Floyd receive the public recognition that their EXTENDED volunteer civic service merits. 

3. Proclamation recognizing August 3, 2021 as National Night Out in Cedar Falls. This summer, I've been delighted to see so many activities initiated by neighbors to connect with each other, including the Gallagher-Bluedorn Block Parties.  COVID and politics have taught us how important it is to support and understand one another, and National Night Out is a great way to do this AND get to know our law enforcement officers at the same time.   There's still time to plan a neighborhood get-together, even if it's just lemonade and cookies.  If you don't know your neighbors yet, now's the time!  Celebrate National Night Out!

Special Order of Business

4. Public hearing on a proposal to enter into an Agreement for Private Development with CV Commercial, L.L.C. relative to a commercial/residential mixed use development. Developer Brent Dahlstrom is requesting the customary five-year, 5% tax abatement as an incentive for re-developing several properties into a single 5 story mixed-use building on College Hill.  This is a common incentive to provide for these kinds of developments. The tax abatement program is a useful tool for encouraging infill development, which is important to long-term community vitality.

5. Public hearing on the proposed plans, specifications, form of contract & estimate of cost for the 2021 CDBG Sidewalk Infill Project. This action will allow the city to move forward with getting contractor bids for this $176K  project, which will install sidewalks along existing roadways (in keeping with the city's Complete Streets policy).  This will be fully funded with federal Community Development Block Grant (CDBG) funds.

6. Public hearing on the proposed plans, specifications, form of contract & estimate of cost for the 2021 Public Sidewalk Repair and Infill Project. This will use $191K in Cedar Falls taxpayer funds to address various deficiencies in the city's sidewalks to comply with the legal requirements of the Americans with Disabilities Act (ADA).

8. Public hearing on the proposed plans, specifications, form of contract & estimate of cost for the 2021 Permeable Alley Project. This sets $107K to construct two alleyways, between 12th/13th & Washington/Main, and 9th/10th & Main & State.

Old Business

9. Pass Ordinance #2992, amending Chapter 23, Traffic and Motor Vehicles, of the Code of Ordinances relative to the speed limit on certain portions of Viking Road, upon its second consideration. This updates the speed limit to Iowa DOT standards, and was discussed in our previous meeting.  It will require one more reading in August to become law. 

New Business

10. Approve the following recommendations of the Mayor relative to the appointment of members to Boards and Commissions: Thanks to these outstanding citizens for their willingness to serve on the city's boards and commissions; we couldn't carry out citizen-driven government without the volunteerism of great community members like these. 

a) Phyllis Carter, Community Center & Senior Services Board, term ending 06/30/2024.
b) Crystal Ford, Civil Service Commission, term ending 04/04/2022.
c) Rebecca Whitaker, Human Rights Commission, term ending 07/01/2022.

11. Receive and file the Committee of the Whole minutes of July 6, 2021 relative to the following items:  This simply approves the minutes as an accurate reflection of what transpired in the meeting, and is not a time to debate the merits of the items themselves. 

a) Incident Command System with County EMA.
b) Parking Ordinance Amendments.

12. Approve the following applications for beer permits and liquor licenses: The city council is the approving authority for all alcohol permits. 

a) Cypress Lounge, 209 A State Street, Class C liquor & outdoor service - renewal.
b) Hy-Vee Market Grille, 6301 University Avenue, Class C liquor - renewal.
c) George’s Local, 108 E. 4th Street, Class C liquor & outdoor service – new with exceptions. (see attached).
d) Wal-Mart, 525 Brandilynn Boulevard, Class C liquor – change in ownership.

13. Resolution approving and authorizing execution of a Client Agreement with Express Scripts, Inc. relative to pharmacy benefit management services. This is a standard agreement as part of the city's health care plan, for improved rates. 

14. Resolution approving and authorizing execution of a Lease Estoppel Certificate relative to a Lease Agreement between the City, the Board of Trustees of the Municipal Electric Utility, and Cedar Falls Solar Farm, LLC for the use of certain city-owned property located at 800 Viking Road as a solar garden. We passed a similar agreement previously, but the buyer fell through.  This is the same agreement with a new purchaser.   The city remains the landlord, the CFU remains the tenant, and Cedar Falls Solar Farm, LLC remains the sub-tenant.

15. Resolution approving and accepting three Temporary Easements for construction, in conjunction with the FFY20-21 CDBG Sidewalk Infill Project. These easements are necessary for carrying out this project, and will cost the taxpayers approximately $5,140. 

16. Resolution approving and accepting three Temporary Construction Easements, in conjunction with the Cyber Lane Extension Project. This easement is necessary for carrying out this project, and will cost the taxpayers $3 (a nominal consideration required for legal contracts of this type). 

17. Resolution approving and authorizing the expenditure of funds for the purchase of a loader mounted snow blower for the Public Works Department. This will expend $160K in taxpayer funds to purchase a new unit; the old unit will be sold to the City of Hudson for $14,000. 

18. Resolution approving and authorizing the expenditure of funds for the purchase of transfer station equipment, in conjunction with the Transfer Station Pit Refurbishing Project. This action would allocate $58K in refuse funds to the rebuild of that "walking floor" and hydraulics at the Transfer Station.  

19. Resolution receiving and filing the bids, and approving and accepting the low bid of Owen Contracting, Inc., in the amount of $296,323.66, for the Cyber Lane Extension Project. This action would allocate $296K in TIF funds from the South Cedar Falls TIF District to construct a Cyber Lane (which is necessary for future development along that cooridor). 

20. Resolution approving and authorizing execution of a Professional Service Agreement with Foth Infrastructure and Environment, LLC for design, construction and acquisition services relative to the Main Street Reconstruction Project. This action would authorize up to $1.9M for roadway design, right of way aquisition and construction services for the reconstruction of Main Street. Pages 132 and 133 list the scope of services for the project, for which assumptions include roundabouts at 12th, 18th and Seerley Boulevard (and possibly at 6th Street). It also would design the roadway as two-lane with a center turn lane and bicycle lanes on the outside. 

21. Resolution receiving and filing, and setting August 2, 2021 as the date of public hearing on the proposed plans, specifications, form of contract & estimate of cost for the 2021 Seal Coat Project. This simply sets the date for this hearing. 

22. Resolution receiving and filing, and setting August 2, 2021 as the date of public hearing on the proposed plans, specifications, form of contract & estimate of cost for the 2021 Street Patching Project.  This simply sets the date for this hearing.  

Ordinances:

23. Pass an ordinance amending Chapter 23, Traffic and Motor Vehicles, of the Code of Ordinances relative to parking restrictions in municipal parking lots, upon its first consideration. This ordinance change follows last Committe of the Whole's presentation by staff for eliminating paid parking in the downtown lots, and restricting paid parking on College Hill to the non-summer months.  This will need to be approved in three separate readings in order to be adopted into the city code.
