Annotated Agenda for 9/19/2022

The big items for Monday night's 7pm meeting are consideration of approval for the Destination Iowa  matching grant application which would seek to better connect the downtowns of Waterloo and Cedar Falls through river amenities (Items #17 and #18), and approval of a grant application which would fund the removal of the unused railroad line downtown for a cost of $1.2M using various funding sources.   

Before that meeting, the Standing Committees will meet at 5:50 to discuss possible changes to the Zoning Amendments voting threshold, and the results of a downtown restroom study referred to staff for research.

4. Hearing on a complaint issued to Zainab LLC, d/b/a Up in Smoke, 2218 College Street, for a second tobacco violation.  Tobacco violation penalty assessments require a public hearing before the City Council.

a) Oral comments.

b) Approve and authorize execution of an Order Assessing Penalty relative to a Second Tobacco Violation regarding Up in Smoke, 2218 College Street.

5. Pass Ordinance #3016, amending Chapter 2, Administration, of the Code of Ordinances relative to adoption of revised City Council Meeting Procedures, upon its second consideration.  This item was discussed in the previous council meeting; it passed the first reading with an amendment, and now moves to the second reading; if passing this time, it will move to final reading on October 3rd and then would be adopted into the City Code.

6. Pass Ordinance #3017, amending Chapter 23, Traffic and Motor Vehicles, of the Code of Ordinances relative to prohibiting parking on portions of Utility Parkway, upon its second consideration. This is the second of three required readings.

7. Receive and file the City Council Standing Committee minutes of September 6, 2022 relative to the following items:

8. Receive and file the resignation of Beverly Michael as a member of the Health Trust Board. 

9. Approve the following recommendations of the Mayor relative to the appointment of members to Boards and Commissions: Thanks to these citizens for their williness to serve the people of Cedar Falls as a board or commission member.  You can apply for service at www.cedarfalls.com/boards. 

a) Donna Mallin, Human Rights Commission, term ending 07/01/2023.

10. Approve the following applications for beer permits and liquor licenses: The City Council is the approving authority for all alcohol permits and liquor licenses.

a) Murphy USA, 518 Brandilynn Boulevard, Class C beer & Class B wine- renewal.

b) Escapology Cedar Falls, 2518 Melrose Drive, Special Class C liquor - renewal.

c) Holiday Inn & Suites Hotel/Event Center, 7400 Hudson Road, Class B liquor & outdoor service - renewal.

d) The Ragged Edge Art Bar & Gallery, 504 Bluff Street, Class C liquor & outdoor service – renewal.

e) Fareway Store, 214 North Magnolia Drive, Class E liquor - renewal.

f) Fast Track Racing, 200 block West 2nd Street, Class B beer & outdoor service – change in ownership.

11. Resolution approving the recommendation for the reappointment of the Acting Police Chief. This simply continues the current assignment of Acting Chief Howard, until the permanent Police Chief is appointed later this year.

12. Resolution approving and authorizing execution of an Agreement for Animal Services with the Cedar Bend Humane Society for October 1, 2022-June 30, 2027. This contract simply adjusts fees slightly, for continuance of the existing arrangement Cedar Falls has with CBHS for animal control. 

13. Resolution approving an Application for Tax Abatement under the College Hill Urban Revitalization Plan for residential building improvements located at 1803 College Street. This would allow the developer to receive a tax abatement for the remodeling of the house on the SW corner of College & 18th.

14. Resolution approving an Application for Tax Abatement under the College Hill Urban Revitalization Plan for residential building improvements located at 1809 College Street. This would allow the developer to receive a tax abatement for constructing a new home on College Street near 18th.

15. Resolution approving and authorizing execution of a Service/Product Agreement with Ostby Dance relative to providing Ballroom Dance classes. This allows the dance instructors to advertise and use Recreation Center facilities and sign-up processes to host a ballroom dance course.  The city would then receive a 20% cut of the enrollment fees.  This public/private partnership is an excellent way to leverage private talent with public resources for the good of our community.

16. Resolution approving and authorizing submission of an Iowa Tourism Grant application for Cedar Falls Pocket Guides and Information Kiosks. This would allow the city to apply for a $10K grant to fund this informational project.

17. Resolution approving and authorizing submission of a Destination Iowa grant application, and designating the Mayor as the official representative of the City relative to the Cedar Valley River Experience Project. This resolution would allow the grant applicants to formally apply for the $8.4M grant.  With Waterloo's approval as well, Cedar Falls would be on the hook to provide $340K in funding for CF projects, while Waterloo would be required to provide $8.4M in funding 

18. Resolution granting the Iowa Economic Development certain financial assurances for the Cedar Falls match portion of the Destination Iowa Grant request relative to the Cedar Valley River Experience Project. This resolution would be solely to assure the IEDA that Cedar Falls will provide the $340K in funding for the Destination Iowa grant, if we receive the funding.  This can be a combination of City, County, and Private funds. 

19. Resolution approving and authorizing submission of a Railroad Crossing Elimination (RCE) Grant application to the Federal Railroad Administration; and approving and authorizing the local match relative to abandoning and removing the Cedar Falls Rail Spur. This project, which would be 80% federally funded as part of the Bipartisan Infrastructure Bill, would allow Cedar Falls to take out the railroad tracks from downtown which have been almost completely unused since 2010. This change would open benefit the city in several ways, including a new rail-trail connection directly from Washington Park to Pfeiffer Springs Park.   The federal funding provides a once-in-a-generation opportunity to deal with the unused rail line, and I'm excited to see this happen.

20. Resolution approving and accepting the contract and bond of Iowa Flatworks, Inc. for the 2022 Sidewalk Assessment Project – Zone 5. This is a standard contract for the contractor that submitted the low bid for this project in the last council meeting.

21. Resolution approving the Certificate of Completion and accepting the work of Pirc-Tobin Construction, Inc. for the West 27th Street Sanitary Sewer Extension Project. This allows the contractor to be paid for the work done on the new sanitary sewer, at a total of $289K.

22. Allow Bills and Claims for September 19, 2022. The council is the approving authority for all bills and claims submitted since the previous council meeting.

23. Executive Session to discuss Property Acquisition per Iowa Code Section 21.5(1)(j) to discuss the purchase or sale of particular real estate only where premature disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property or reduce the price the governmental body would receive for that property; and for discussion of the City Administrator’s performance pursuant to Iowa Code Section 21.5(1)(i) and City Code Section 2-217.
