Annotated Agenda for 5/4/2020

Monday night's council meeting will be carried out via Zoom videoconference.  It will include several public hearings, including one on proposed amendments to the FY20 Budget, which is in effect until July 1.  Other items on the agenda are fairly administrative/routine.   

Prior to that, we'll have a Committee of the Whole at 6:05 to learn about proposed adjustments to the Capital Improvements Plan (CIP); some projects will likely need to be re-shuffled due to funding issues from the COVID-19 pandemic. It will be an important discussion.

1. Regular Meeting of April 20, 2020.  This action enters the minutes into the record as an accurate reflection of what transpired at the meeting; rather than as a debate of the merits of the discussion items themselves.

2. Public hearing on the proposed rezoning from A-1, Agricultural, to R-1, Residential and M-1, P, Planned Light Industrial, of recently annexed property located south of West Viking Road and east of South Union Road, and also on an associated amendment to the Future Land Use Map by changing the designation from undesignated to Industrial, Low Density Residential, and Public and Utilities. This is the public's opportunity to comment on this item prior to City Council dialogue.

3. Pass an ordinance amending Section 26-121 of the Code of Ordinances by rezoning from A-1, Agricultural, to R-1, Residential and M-1, P, Planned Light Industrial, of recently annexed property located south of West Viking Road and east of South Union Road, upon its first consideration. This change to the zoning map would allow the newly annexed property on the southwest of town to be used for mostly industrial purposes.

4. Resolution amending the Future Land Use Map, by changing the designation from undesignated to Industrial, Low Density Residential, and Public and Utilities, for recently annexed property located south of West Viking Road and east of South Union Road. 6. Resolution approving and adopting amendments to the City's FY20 Budget. I will request an overview from staff for the requested changes in the budget, and an explanation of why they are necessary and what it means to the city's bottom line.

7. Pass Ordinance #2963, amending the boundaries for wards and precincts within the City of Cedar Falls to incorporate recently annexed territory, upon its second consideration. This item was discussed in last week's council meeting; this is the second of three required approvals for it to become law. No questions.

8. Pass Ordinance #2964, amending Chapter 16, Offenses and Miscellaneous Provisions, of the Code of Ordinances relative to prohibiting loitering, upon its second consideration. This item was discussed in last week's council meeting; this is the second of three required approvals for it to become law. No questions.

9. Pass Ordinance #2965, amending Chapter 17, Parks and Recreation, of the Code of Ordinances relative to noxious weeds, upon its second consideration. This item was discussed in last week's council meeting; this is the second of three required approvals for it to become law. No questions.

New Business

Consent Calendar: (The following items will be acted upon by voice vote on a single motion without separate discussion, unless someone from the Council or public requests that a specific item be considered separately.)

10. Receive and file a proclamation recognizing May 2020 as Bike Month and May 20th as Ride of Silence Day. I'm happy to promote bicycling whenever I can; you can see the video explaining this proclamation at https://www.facebook.com/rgreencf/videos/1588038848015179/. 

11. Receive and file a proclamation recognizing May 2020 as Neurofibromatosis Awareness Month and May 17th as World Fibromatosis Awareness Day. No questions; thank you to TJ Warren for bringing forward this important proclamation for consideration. I look forward to interviewing him later this month about NF.

12. Approve the following recommendation of the Mayor relative to the appointment of members to Boards and Commissions: The City Code requires Human Rights Commission vacancies to be filled within 60 days of the vacancy; I understand this vacancy occurred in August, so I should have pursued an appointment immediately upon taking office as Mayor.  I didn't learn of this requirement until recently, and apologize for my oversight.  Thank you to all the applicants who were willing to serve!

a) Lisa R. Thomas, Human Rights Commission, term ending 07/01/2022.

13. Receive and file Departmental Monthly Reports of March 2020. No questions; though buildings have been closed to the public for part of March, staff has still been hard at work, particularly with back-burner preventive maintenance items.

14. Receive and file the Bi-Annual Report of Community Main Street relative to FY20 Self-Supported Municipal Improvement District (SSMID) Funds and an FY20 Economic Development Grant. This report, delivered twice a year, is required by the City Council in order for the group to retain its SSMID status.  No questions about the report contents, though I wonder if we could make this report due annually to reduce the administrative burden on the CMS.  I'll ask.

15. 18. Resolution approving and adopting an Amendment to Implement Over-the-Counter Medications for the City's Cafeteria Plan relative to implementing provisions of the CARES Act of 2020. This is an administrative change to account for additional qualified medical expenses. No questions.

19. Resolution approving and authorizing execution of an Agreement for Wrecker/Towing/Storage Service with L&M Transmission. This is the standard annual contract for  the city's towing of vehicles when necessary. No questions.

20. Resolution approving and authorizing execution of an Agreement for Wrecker/Towing/Storage Service with Rasmusson Towing, Inc. This is the standard annual contract for  the city's towing of vehicles when necessary. No questions.

21. Resolution receiving and filing the bids, and approving and accepting the low bid of Failor Hurley Construction, Inc., in the amount of $209,800, for the Cedar Falls Recreation Center – Locker Rooms Renovation Project. This will allow the contractor to move forward with the renovation project. It's significantly less than the budgeted $500K, so I'll ask why the large gap.

22. Resolution approving and accepting the contract and bond of Failor Hurley Construction, Inc. for the Cedar Falls Recreation Center – Locker Rooms Renovation Project. This is administrative details needed for the contractor to carry out the project in #21. No questions.

23. Resolution approving and authorizing submission of an application for Traffic Safety Improvement Program (TSIP) funding with the Iowa Department of Transportation relative to the Greenhill Road and South Main Street Intersection Improvements. This is a proposal to the state for up to $500K in grant funds changes to the Greenhill/South Main intersection.

24. Resolution receiving and filing, and setting May 18, 2020 as the date of public hearing on the proposed plans, specifications, form of contract & estimate of cost for the 2020 CDBG Sidewalk Infill Project. No questions about the proposed date of hearing.
