Monday night's meeting (starting at 7pm) is fairly routine; the only major new items (in my opinion) are a request for city council to appoint an acting police chief for 180 days (Item 11) and an ordinance revision which would remove exemptions for pre-1969 homes to tap into the sanitary sewer to remove stormwater.
Prior to that meeting, at 5:10 the council will meet in a work session to discuss collaborative opportunities with senior UNI leadership (50 minutes) and then a continuation of our discussion of the new downtown zoning ordinance.

4. Pass Ordinance #3006, amending Chapter 26, Zoning, of the Code of Ordinances relative to increasing parking ratios for residential mixed-use and multi-unit buildings in the Downtown Character District to 0.75 parking spaces per bedroom, but not less than one parking space per unit, as recommended by the Planning & Zoning Commission, upon its second consideration. The Council discussed this proposed change in its last meeting, and it was passed on its first consideration. I will need to pass on 3/21 and then again on 4/4 in order to be added to code of ordinances.

5. Approve the following recommendation of the Mayor relative to the appointment of members to Boards and Commissions:

9. Receive and file a communication from the City Administrator relative to the appointment of an Acting Public Safety Director. Section 2-920 of the city code of ordinances directs the City Administrator to appoint an acting public safety director when the position is vacant.
10. Approve the following applications for beer permits and liquor licenses: The council is the approving authority for all alcohol permits.
a) Barn Happy, 11310 University Avenue, Class B native wine - renewal.
b) Social House, 2208 College Street, Class C liquor & outdoor service - renewal.

11. Resolution approving the recommendation of the Acting Public Safety Director and City Administrator relative to the appointment of an Acting Police Chief. Section 2=949 allows an Acting Police Chief to be appointed during periods when the Police Chief is unable to carry out their duties. Because Chief Berte is currently serving as the Acting Public Safety Director, I believe it is appropriate to appoint an Acting Police Chief for the duration as well. Because a new Police Chief will likely not be appointed within 90 days, the administrator is requesting for the City Council to grant a 180 day appointment. I will ask staff to clarify how Iowa Code 400.11 applies in this case, as it states that:
"the person or body having the appointing power may temporarily fill a newly created office or other vacancy only until an examination can be held and the names of qualified persons be certified by the commission, and such temporary appointments are hereby limited to ninety days for any one person in the same vacancy, but such limitation shall not apply to persons temporarily acting in positions regularly held by another."
12. Resolution approving and authorizing execution of a Master Service Agreement with IP Pathways, LLC, relative to providing data backup and disaster recovery services. This cybersecurity agreement is necessary for the city to retain insurance and would apply $135K in taxpayer funds for three years of service.
13. Resolution approving and authorizing execution of a HOME Investment Partnership Program Consortium Cooperation Agreement with the City of Waterloo for FY2023-2025. This great program allows Cedar Falls to receive federal funds for the purchasing of empty lots and residences for the donation to Habitat for Humanity, so that new homes can be available for purchase by residents who otherwise might be unable to achieve homeownership. Because homeownership is a key way to build up wealth -- and especially intergenerational wealth -- I am very supportive of these kinds of programs.
14. Resolution approving and authorizing execution of three Service/Product Agreements relative to removal of hazardous trees on private property, and authorizing the City Operations & Maintenance Division Manager to approve individual property quotes. These agreements would allow the three tree removal services to bid on tree-removal projects on private properties (for hazardous/dying trees) and for city staff to approve bids. This is a smart idea as there will be many trees to remove in the years ahead. These are only for trees afflicted by emerald ash borer.
15. Resolution approving the Certificate of Completion and accepting the work of Peterson Contractors Inc. for the West 12th Street Reconstruction Project, and approving and authorizing the transfer of funds from the Street Construction Fund to the Street Improvement Fund. This closes out the project and allows the contractor to be paid. This was a very significant project, which excavated part of the hill so that the Walnut Street part of that intersection is less steep, improving safety.
16. Resolution approving and accepting the contract and bond of Peterson Contractors, Inc. for the 2022 Street Construction Project. This step allows Peterson to proceed with the project.
17. Resolution receiving and filing the bids, and approving and accepting the low bid of Municipal Pipe Tool Company, in the amount of $248,119.50, for the 2022 CDBG Sanitary Sewer Rehabilitation Project. This step selects Municipal Pipe Tool for the project.
18. Resolution approving and authorizing execution of a Revised Owner Purchase Agreement, and approving and accepting a Warranty Deed, in conjunction with the Olive Street Box Culvert Project. This pays the homeowner $110K for the home and property. The land will be needed by the city for the culvert project.
19. Resolution receiving and filing, and setting April 4, 2022 as the date of public hearing on the proposed plans, specifications, form of contract & estimate of cost for the College Hill Parking Lot Improvements Project. This simply sets the date for the hearing for these parking lot improvements.
20. Resolution setting April 4, 2022 as the date of public hearing on a proposed amendment to Chapter 26, Zoning, of the Code of Ordinances relative to principal permitted uses in the M-1 Light Industrial District. This simply sets the date for the hearing for an amendment to allow child day care facilities in the M-1 district .
Ordinances:
21. Pass an ordinance amending Chapter 7, Building and Building Regulations, of the Code of Ordinances relative to discharge of stormwater or groundwater into the city sanitary sewer system, upon its first consideration. This amendment would remove the exemption for pre-1969 buildings which allowed them to have their stormwater lines connected to the sanitary sewer. Treating stormwater in our sewage treatment plant is needlessly expensive.
