Happy Sunday neighbors!  What a glorious weekend!  This might be the shortest council packet I've ever reviewed...there really isn't anything exciting in this Council meeting, from my vantage point, but I hope you'll still come; at 6:20 in the Standing Committees, the Public Safety Committee will review the options for updates to the Fireworks Ordinance, based on what we learned this past summer.  Should be interesting!  I hope you can join us in-person or online on Channel 15 and YouTube.  Thanks for doing the work to be an informed and engaged resident, even during the light weeks!

4. Pass Ordinance #3016, amending Chapter 2, Administration, of the Code of Ordinances relative to adoption of revised City Council Meeting Procedures, upon its third & final consideration. This was discussed in previous meetings, and is the required third reading.  This is simply a housekeeping measure to clean up the city code after the adoption of our new Council Meeting Procedures.  It's counterproductive to have to maintain instructions in both City Code and in the meeting procedures, so this change fixes that.

5. Pass Ordinance #3017, amending Chapter 23, Traffic and Motor Vehicles, of the Code of Ordinances relative to prohibiting parking on portions of Utility Parkway, upon its third & final consideration. Just eliminates parking on the north southeast side of Utility Parkway, for the safety of the utility vehicles.

6. Receive and file the City Council Standing Committee minutes of September 19, 2022 relative to the following items:

a) Zoning Amendments Voting Threshold.
b) Downtown Public Restroom Study.

7. Receive and file Departmental Monthly Reports of August 2022.

8. Receive and file a communication from the Civil Service Commission relative to the certified list for the position of Assistant Public Safety Director/Police Chief. The Civil Service Commission has determined that of all applicants for the Police Chief position, two candidates were found to be qualified for appointment.  This communication just notes this finding, and the City Council does not have a legal role in approving this list. 

9. Approve the application of J & M Displays, Inc. (Holiday Hoopla) for a fireworks display permit for November 25, 2022.  This is a standard approval that the City Council gives each year for Holiday Hoopla fireworks.

10. Approve the following applications for beer permits and liquor licenses:  The city council is the approving authority for all beer permits and liquor licenses.

a) Blue Room, 201 Main Street, Class C liquor - renewal. 
b) Lark Brewing, 6301 University Avenue, Class C liquor, Special Class A beer & outdoor service – renewal.
c) The Landmark, 107 Main Street, Class C liquor & outdoor service - renewal.
d) Tony's La Pizzeria, 407 Main Street, Class C liquor & outdoor service - renewal.
e) Casey's General Store, 601 Main Street, Class E liquor - renewal.
f) Casey's General Store, 601 Main Street, Class E liquor – change in ownership.
g) Amvets, 1934 Irving Street, Class A liquor & outdoor service - temporary expansion of outdoor service area. (October 1 - November 30, 2022)

Resolution Calendar: (The following items will be acted upon by roll call vote on a single motion without separate discussion, unless someone from the Council or public requests that a specific item be considered separately.)

11. Resolution approving and authorizing execution of a contract with the Governor’s Traffic Safety Bureau (GTSB) relative to funding for traffic enforcement and training. This $9K grant from the State of Iowa will go toward traffic enforcement overtime costs and training, and is similar to grant agreements approved in past years. 

12. Resolution approving and authorizing execution of a License Agreement with Aureon Network Services relative to installing a fiber optic telecommunications system within the public right-of-way of 18th Street, Waterloo Road and University Avenue. This allows Aureon to bury fiber optic cable in the city's right of way.

13. Resolution approving and authorizing execution of a Preconstruction Agreement for Primary Road Project with the Iowa Department of Transportation (IDOT) relative to the Highway 58 & Ridgeway Avenue Reconstruction Project. This legal agreement is necessary for IDOT to move forward with the reconstruction of the Highway 58 corridor around Ridgeway Avenue. 

14. Resolution approving and adopting payment standards for the Housing Choice Voucher Program relative to the Section-8 Housing Program. This approval would increase the support amount for Section 8 housing applicants, as a passthrough of Federal funds (no direct cost obligation to Cedar Falls taxpayers).  This change will more closely align the assistance provided by the city with what the actual rental costs are in our community.

15. Resolution setting October 17, 2022 as the date of public hearing to consider proposed amendments to Section 18-23(5) and Section 26-4(c) of the Code of Ordinances relative to voting threshold required to override Planning and Zoning Commission. This action simply sets the date for the hearing.

16. Pass an ordinance amending Chapter 24, Utilities, of the Code of Ordinances relative to establishing the 27th Street Sanitary Sewer Extension District, upon its first consideration. This is a necessary legal addition in order to charge tapping fees and otherwise administer our new sanitary sewer on 27th Street. 

Allow Bills and Claims

17. Allow Bills and Claims for October 3, 2022. The council is the approving authority for all bills and claims made against the city since the previous regular council meeting.
