Annotated Agenda for 12/6/2021

Tonight's City Council meeting at 7pm is mainly some fairly routine administrative items.  In addition, the council will consider approval of two revised job classifications for Public Safety Supervisors (Items 12 and 13), the contract for the city hall remodel (Item 16), the plats and site plan for Creekside Luxury Condos on Cedar Heights Drive (Items 19 - 21) and collective bargaining agreements with the teamsters union (Items 30 and 31). 

Prior to this, at 6:30pm the Committee of the Whole will meet to hear an update from Grow Cedar Valley.  I hope you can attend in person or online, and thanks for doing the work to be an informed and engaged citizen.

1. Regular Meeting of November 15, 2021.  Simply adds the minutes to the official record as an accurate reflection of what transpired in the meeting.

4. Public hearing to consider taking action on a petition relative to the reestablishment of the Downtown Cedar Falls Self-Supported Municipal Improvement District (SSMID).  No concerns.

a) Receive and file proof of publication of notice of hearing. (Notice published November 19, 2021)

b) Written communications filed with the City Clerk.

c) Staff comments.

d) Public comments.

e) Pass an ordinance amending Chapter 2, Administration of the Code of Ordinances relative to reestablishing the Downtown Cedar Falls Self-Supported Municipal Improvement District (SSMID), upon its first consideration.

Old Business

5. Pass Ordinance #3000, granting a partial property tax exemption to The Vault, LLC for construction of a storage/office facility at 6100 Production Drive, upon its second consideration. No concerns.

6. Pass Ordinance #3001, amending Chapter 24, Utilities, of the Code of Ordinances, relative to sanitary sewer rates, upon its second consideration. No concerns.

New Business

7. Approve the following recommendation of the Mayor relative to the appointment of members to Boards and Commissions:

a) Russell Curtis, Health Trust Fund Board of Trustees, term expiring 12/31/2026.

8. Receive and file the Committee of the Whole minutes of November 15, 2021 relative to the following items: Simply adds the minutes to the official record as an accurate reflection of what transpired in the meeting.

a) Main Street Reconstruction and Right of Way.

b) FY2021 Audit Report.

9. Receive and file Departmental Monthly Reports of October 2021.

10. Approve the following applications for beer permits and liquor licenses: 

a) Cedar Falls Woman's Club, 304 Clay Street, Special Class C liquor - renewal.

b) Moonshine Mob Bar, 419 Main Street, Class C liquor – renewal.

c) Sharky's Fun House, 2223 College Street, Class C liquor & outdoor service - renewal.

d) The Brown Bottle, 1111 Center Street, Class C liquor & outdoor service - renewal.

e) Cedar Falls Family Restaurant, 2627 Center Street, Class B beer - new.

11. Resolution approving and authorizing submission of a 2022 Most Endangered Properties nomination by the Historical Preservation Commission to Preservation Iowa relative to the Honors Cottage at the University of Northern Iowa. The Historic Preservation Commission requested to present the Honors Cottage to a non-profit historical preservation group called Preservation Iowa.  UNI wishes to discuss this before the application is sent to Preservation Iowa, so I am withdrawing it from tonight's agenda for potential submission later.   The deadline for application for FY2022 is tomorrow (December 7th), which is why the submission was a matter of some urgency. I look forward to hearing UNI's input on the application in the coming weeks.

12. Resolution approving and adopting a revised job classification for the position of Public Safety Supervisor - Captain in the Public Safety Services Department. The newly revised job classifications are in response to orders from a recent court case. The new classification provides greater specificity in the qualifications for the position.  All job descriptions need to include a timeframe of when required certifications must be obtained; this description does so.

13. Resolution approving and adopting a revised job classification for the position of Public Safety Supervisor - Lieutenant in the Public Safety Services Department. Same as #12.

14. Resolution supporting Community Main Street, Inc., and approving and authorizing execution of a Main Street Iowa Program Continuation Agreement with Community Main Street, Inc. and the Iowa Economic Development Authority for the purpose of continuing the Main Street Program in Cedar Falls. This three-year agreement provides for technical support for our downtown economic vitality.  There are no financial obligations to the city beyond our usual support to the infrastructure of downtown and our financial support to Community Main Street.

15. Resolution approving and adopting amendments to the Housing Choice Voucher Program Administrative Plan relative to the Section-8 Housing Program. These amendments to the plan provide more clarity and specificity to program eligibility for Section 8 housing.  Notably, it provides more discretion to city staff for addressing applications from those with a criminal record, due to the disparity of arrests for persons of color.  This is in line with the spirit of recommendations from the Cedar Falls Racial Equity Task Force regarding housing.  

16. Resolution approving and accepting the contract and bond of Peters Construction Corporation for the City Hall Remodel Project. This $3.85M contract will allow the remodeling project to commence immediately.

17. Resolution approving and accepting a Lien Notice and Special Promissory Note for property located at 610 West 28th Street relative to the Rental to Single Family Owner Conversion Incentive Program. This would provide a $10K forgivable loan for exterior improvements to this property.

18. Resolution approving a Shopping Center (S-1) Zoning District site plan for patio improvements at 6607 University Avenue. This would add a permanent patio roof at the new Starbeck's Smokehouse BBQ.

19. Resolution approving the preliminary plat of Creekside Luxury Condos. This would turn three plats into one to allow for the development of the condominium structures along Cedar Heights Drive, so that the project can proceed.

20. Resolution approving the final plat of Creekside Luxury Condos. Same as #19 above; the developer is ready to move ahead with the final plat.

21. Resolution approving a Planned Residence (R-P) Zoning District site plan for construction of a multi-unit residential development in the vicinity of Cedar Heights Drive and Valley High Drive. These are the detailed construction plans for new condominiums for council approval.  The Planning & Zoning Commission is recommending approval unanimously, and great care has been taken to seek to address concerns from neighboring residents.

22. Resolution approving and authorizing execution of an Extension of a Yard Waste Management Service Agreement with T&W Grinding relative to management of the City’s compost facility. This would allocate $72.9K for a 1 year extension to the contract; I support these efforts to privatize city services whenever it is cost-effective to do so.

23. Resolution approving and accepting completion of public improvements in Greenhill Village Estates. This council action would state that the developer has finished all new streets and other infrastructure in that vicinity to the city's satisfaction.

24. Resolution receiving and filing the bids, and approving and accepting the low bid of Petersen Contractors, Inc., in the amount of $3,329,289.25, for the Greenhill Road and South Main Street Intersection Improvement Project. Receipt of the bid willl alow the contract to be created so that the project can be commenced in 2022.

25. Resolution approving and authorizing execution of three Owner Purchase Agreements, and approving and accepting three Temporary Construction Easements, in conjunction with the Greenhill Road & South Main Street Intersection Improvements Project. This approval allows the city to purchase the property sections needed to build the Greenhill & South Main roundabout.

26. Resolution setting December 20, 2021 as the date of public hearing on a proposed ordinance establishing new boundaries for wards and precincts. The city has to update the ward maps due to the results of the 2020 national census.   This activity takes place every ten years. No concerns about the hearing date.

27. Resolution setting December 20, 2021 as the date of public hearing on a proposal to undertake a public improvement project for the Main Street Reconstruction Project, and to authorize acquisition of private property for said project. No concerns about the hearing date.

Allow Bills and Claims

28. Allow Bills and Claims for December 6, 2021. The city council is the approving authority for all bills and claims made against the city since the last city council meeting.

Executive Session

29. Executive Session to discuss Collective Bargaining per Iowa Code Section 20.17(3) as negotiating sessions, strategy meetings of public employers, mediation, and the deliberative process of arbitrators; and Property Acquisition per Iowa Code § 21.5(1)(j) to discuss the purchase or sale of particular real estate only where disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property or reduce the price the governmental body would receive for that property. The city will move to an executive session to discuss these confidential topics, then return to open session  to vote on them in items #30 and 31 below. It's the first time in four years that we'll have come back to an open session for new items, but it makes sense in this case.   The details of the proposed changes are included in the packet.
