Annotated Agenda for 4/19/2021

The Monday night City Council meeting agenda appears to be largely administrative and non-controversial in nature.   That meeting starts at 7pm.   Prior to then, at 6:05 the council will meet in a work session to discuss potential changes to the council packet deadlines, to provide the council and public more time to review the packet prior to the meeting.   And at 6:35, the Council will hear a presentation on the purpose and activities of the county's Solid Waste Commission.   All of these will be held in the council chambers at City Hall.

1. Regular Meeting of April 5, 2021. This simply enters the minutes into the official record as an accurate reflection of what transpired in the meeting. It is not an appropriate time to debate the merits of the items themselves.

Special Presentations It's the privilege of the Mayor to commemorate and increase public awareness of certain noteworthy days through official Proclamations.

2. Proclamation recognizing the week of April 18-24, 2021 as Administrative Professional Week and April 21, 2021 as Administrative Professionals Day.

3. Proclamation recognizing April 18-24, 2021 as City-Wide Cleanup Week.

4. Proclamation recognizing April 18-24, 2021 as National Volunteer Week.

5. Proclamation recognizing April 30, 2021 as Arbor Day.

6. Proclamation recognizing May 2021 as Neurofibromatosis Awareness Month and May 17, 2021 as World Neurofibromatosis Awareness Day.

Special Order of Business

7. Hearing on a proposed resolution adopting and levying the final schedule of assessments for the 2020 Sidewalk Assessment Project, Zone 3. This is an action we take every year, in order to bill and collect payments from property owners who were required to correct sidewalks that don't comply with city code.

Old Business

8. Pass Ordinance #2988, amending Chapter 2, Administration, of the Code of Ordinances relative to mayor and city administrator duties, upon its second consideration. These are 'housekeeping' updates to the city code, rather than significant changes to the functions of the Mayor and Administrator.  We've discussed the updates in previous meetings.  This is the second of three required readings. 

New Business

Consent Calendar: (The following items will be acted upon by voice vote on a single motion without separate discussion, unless someone from the Council or public requests that a specific item be considered separately.)

9. Approve the following recommendations of the Mayor relative to the appointment of members to Boards and Commissions: The Mayor vets candidates and the City Council has the final say on appointments of boards and commission members.

a) Mario Basurto, Human Rights Commission, term ending 07/01/2021.

b) Eashaan Vajpeyi, Human Rights Commission, term ending 07/01/2023.

c) Robert Seymour, Metropolitan Transit Authority Board of Trustees, term ending 06/30/2023.

10. Receive and file the resignation of Betty Danielson as a member of the Community Center & Senior Services Board, effective 06/30/2021. Thanks so much to Betty Danielson, for her 16 years of service to the Community Center & Senior Services Board. She has chosen not to seek reappointment to the board when her term expires on June 30th. 

11. Receive and file the Mayor's report relative to appointment of members to the Cedar Falls Racial Equity Task Force. The council didn't direct that they needed to approve the appointments of these task force members, so I am sending it as a 'receive and file' item.  Thank so much to these eight Cedar Valley leaders for helping to guide Cedar Falls to a greater understanding of racial equity issues in our community, and how we can go about resolving them in the years ahead.

12. Receive and file the Committee of the Whole minutes of April 5, 2021 relative to the following item:

a) College Hill Vision Plan. This simply enters the minutes into the official record as an accurate reflection of what transpired in the meeting. It is not an appropriate time to debate the merits of the items themselves. 

13. Receive and file the Bi-Annual Report of Community Main Street relative to FY21 Self-Supported Municipal Improvement District (SSMID) funds and an FY21 Economic Development Grant. This report is required by the city council every six months, as part of the agreement to have an SSMID for the downtown area.  I learn so much from reading these reports.

14. Approve the following applications for cigarette/tobacco/nicotine/vapor permits: The City Council is the approving authority for all of these kinds of permits.

a) B&B West, 3105 Hudson Road.

b) Casey's General Store, 2425 Center Street.

c) Casey's General Store, 5226 University Avenue.

d) Casey's General Store, 5908 Nordic Drive.

e) Casey's General Store, 601 Main Street.

f) Casey's General Store, 1225 Fountains Way.

g) The Landmark, 107 Main Street.

15. Approve the following applications for beer permits and liquor licenses: The City Council is the approving authority for all alcohol permits.

a) Jorgensen Plaza (Table 1912, Diamond Event Center and Gilmore's Pub), 5307 Caraway Lane, Class C liquor, Class B wine & outdoor service - renewal.

b) The Horny Toad American Bar & Grille, 204 Main Street, Class C liquor - renewal.

c) ZSAVOOZ, 206 Brandilynn Boulevard, Class C liquor & outdoor service - renewal.

d) CVS/Pharmacy, 2302 West 1st Street, Class E liquor - renewal.

e) Deringer’s Public Parlor, 314 ½ Main Street, Class C liquor – new.

f) Starbeck’s Smokehouse, 6607 University Ave, Class C liquor & outdoor service – new with exceptions. (see attached)

16. Resolution approving and authorizing execution of a Service/Product Agreement with Eide Bailly, LLP for Audit Services. This is a standard agreement approved every year, to audit the city books.

17. Resolution approving and authorizing execution of a Landlord Estoppel Certificate relative to a Lease Agreement between the City, the Board of Trustees of the Municipal Electric Utility, and Cedar Falls Solar Farm, LLC for the use of certain city-owned property located at 800 Viking Road as a solar garden. This doesn't change anything at the city solar garden on Viking Road, except the change in ownership of the private firm sub-leased to operate the farm on behalf of CFY and the City.

18. Resolution approving and authorizing execution of a Lease relative to property vacated by the 2008 flood buyout programs A teaching garden is a fantastic use of city flood buyout space.  I'm also enthusiastic about the plans to turn non-garden space into pollinator habitat in those areas.  The project is being led by the North Cedar Neighborhood Association, with no cost to the city or taxpayers.

19. Resolution approving and authorizing expenditure of funds for replacement of an automated refuse collection unit. This will commit $223K in taxpayer funds to the purchase of this unit, which is needed for the essential service of refuse collection.

20. Resolution approving and authorizing execution of a contract with Quality Striping, Inc. relative to 2021 pavement marking services. This will commit $44K to the striping and marking of the city's streets and other pavement for traffic and safety.

21. Resolution approving the Certificate of Completion and accepting the work of K. Cunningham Construction Company, Inc. for the Downtown Streetscape and Reconstruction Project, Phase I. This action allows the contractor to receive the final $116K in taxpayer funds for the completion of the first part of downtown streetscaping project.   It's coming along great, and I'm looking forward to seeing phase 2 completed this year as well.

22. Resolution approving and authorizing execution of a Storm Water Maintenance and Repair Agreement with River Place Properties II LC, relative to a post-construction stormwater management plan for 302 Main Street. This is a standard agreement for the handling of stormwater on that infill development property.

23. Resolution approving and authorizing execution of a Professional Service Agreement with Snyder & Associates, Inc. for 2021 survey services. This agreement is to account for the departure of the surveyor on city staff; the contractor would provide these services until a new staff surveyor is hired.

24. Resolution approving a Central Business District (CBD) Overlay Zoning District site plan for temporary wheat paste murals in the Downtown Business District. This approves a graduate student project for temporary art in our downtown area, at no cost to the city.

25. Resolution approving and accepting a Lien Notice and Special Promissory Note for property located at 721 West 17th Street relative to the Rental to Single Family Owner Conversion Incentive Program. This action would provide the property owners with a forgivable loan of $10K in taxpayer funds for exterior improvements to their properties under an existing incentive program.  This grant program has been a fantastic way to encourage the re-conversion of rental properties back to owner-occupied.

26. Resolution approving and authorizing execution of a Subrecipient Agreement for Federally Funded Project with Eastside Ministerial Alliance, Inc. for Community Development Block Grant (CDBG-CV2) funding relative to the CARES Act. This action would pass-through $15K in federal CARES Act funds to this non-profit agency for rent and mortgage assistance for those in need of relief due to COVID-19.

27. Resolution approving and authorizing execution of a Subrecipient Agreement for Federally Funded Project with Jesse Cosby Neighborhood Center, Inc. for Community Development Block Grant (CDBG-CV2) funding relative to the CARES Act. This action would pass-through $10K in federal CARES Act funds to this non-profit agency for rent and mortgage assistance for those in need of relief due to COVID-19.

28. Resolution approving a revised S-1 Shopping Center District site plan for installation of a kiosk for order pick-up service at 6301 University Avenue. This follows on to a site plan approval the council passed last year,  which was not built.  This provides a dedicated space behind the College Square Hy-Vee for vehicles to pick up online orders.

29. Resolution approving a College Hill Neighborhood (CHN) Overlay Zoning District site plan for remodel of a duplex at 704-706 West 28th Street. The owner of this property requested to add two additional bedrooms to each duplex unit, but this was not approved by council.   The new proposal is to add one additional bedroom in each unit's basement.

30. Resolution setting May 3, 2021 as the date of public hearing on proposed amendments to the City’s FY2021 Budget. No concerns about the hearing date.

31. Allow Bills and Claims of April 19, 2021. The council is the approving authority for all bills and claims made against the city since the last council meeting.

Executive Session to discuss

32. Executive Session to discuss Collective Bargaining per Iowa Code Section 20.17(3), and Property Acquisition per Iowa Code Section 21.5(1)(j) to discuss the purchase or sale of particular real estate only where premature disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property or reduce the price the governmental body would receive for the property. This is one of those few cases where the council meets in closed session (i.e. no public viewing) due to the  nature of the topic.
