Annotated Agenda for 10/15/2018

The published agenda does not appear to contain any controversial items.  As usual, let me know if I should have additional concerns about any of the below items.  Council starts at 7pm on Monday night, and at 6:00 PM our Committee of the Whole will receive presentations from Community Main Street, College Hill Partnership, and the Bike & Pedestrian Advisory Committee.  Hope you can join us in person or on Channel 15.

A. Call to Order by the Mayor.  
B. Roll Call.  
C. Approval of Minutes of the Regular Meeting of October 1, 2018.   No concerns.
D. Agenda Revisions.    
E. Old Business:    
  1. Pass Ordinance #2932, granting a partial property tax exemption to Standard Distribution Co. for construction of a warehouse addition at 317 Savannah Park Drive, upon its second consideration.   No concerns.  We discussed this in previous council session.
  2. Pass Ordinance #2933, amending Section 29-107 of the Code of Ordinances by removing property located in the southwest corner of Highway 58 and West Ridgeway Avenue from A-1, Agricultural District, and placing the same in HWY-1, Highway Commercial District, subject to certain conditions, upon its second consideration.   No concerns.  We discussed this in previous council session.
  3. Pass Ordinance #2934, amending Section 29-107 of the Code of Ordinances by removing property located at the north end of Lakeshore Drive from A-1, Agricultural District, and placing the same in R-1, Residence District, upon its second consideration.   No concerns.  We've discussed this in previous council sessions.
F. New Business:    
  1. Consent Calendar: (The following items will be acted upon by voice vote on a single motion without separate discussion, unless someone from the Council or public requests that a specific item be considered separately.)    
  a. Receive and file the Committee of the Whole minutes of October 1, 2018 relative to the following items:
(1) Overman Park Neighborhood Association Presentation.
(2) North Cedar Neighborhood Association Presentation.
(3) South Main and Greenhill Corridor Neighborhood Association Presentation.
(4) Bills & Payroll.
No concerns. I'm glad to see the South Main area more connected, and hope we can add Cedar Heights next year!
  b. Approve the application of Community Main Street (J & M Displays) for a fireworks display permit for November 23, 2018.   No concerns; this fireworks display is for Holiday Hoopla downtown.
  c. Approve the following applications for beer permits and liquor licenses:
(1) Aldi Inc., 6322 University Avenue, Class C beer & Class B wine - renewal.
(2) Murphy USA, 518 Brandilynn Boulevard, Class C beer - renewal.
(3) Hilton Garden Inn, 7213 Nordic Drive, Class B liquor, Class B native wine & outdoor service - renewal.
(4) SingleSpeed Brewing Co., 128 Main Street, Class C liquor & outdoor service - renewal.
(5) Blue Room, 201 Main Street, Class C liquor - change in ownership.
(6) Fareway Store, 214 North Magnolia Drive, Class E liquor - change in ownership.
(7) Just Dough, 6607 University Avenue, Class B beer - new.  
No concerns.
  2. Resolution Calendar: (The following items will be acted upon by roll call vote on a single motion without separate discussion, unless someone from the Council or public requests that a specific item be considered separately.)    
  a. Resolution approving and authorizing execution of an Engagement Letter with The Overture Group, LLC to perform recruitment services relative to the position of City Engineer.   No concerns.  This is a similar process to our hiring efforts for the previous City Engineer.
  b. Resolution approving and authorizing execution of an Agreement for Bookkeeping Services with Sturgis Falls Celebration, Inc.   I have concerns about the propriety of the city providing bookkeeping for non-govenmental entities.  With government entities, we can justify that through 28E agreements.  But it seems like the City of Cedar Falls is inappropriately competing with the free market in offering accounting services to non-profits.  I'll ask for background on this.
  c. Resolution levying a final assessment for costs incurred by the City to mow property located at 804-804 1/2 Seerley Boulevard.   A lein is being placed on this property for failure to pay for the mowing carried out by the city. No concerns.
  d. Resolution levying a final assessment for costs incurred by the City to mow property located at 216 Iowa Street.   Same issue as (c), just a different property (same owner).  I'm only disappointed that the city allowed the weeds to get so high...check out the pictures in the attachment - it looks like a cornfield! No concerns about the levy itself.
  e. Resolution approving and authorizing execution of a First Amendment to Agreement for Animal Services with the Cedar Bend Humane Society relative to pet licensing.   Allows CBHS to process pet licensing for CF pets.  No concerns, but would like to know if this means that the city won't be processing pet licenses at all now.
  f. Resolution approving and authorizing execution of an Agreement for Lease of Artwork with Dallas Guffey relative to placement of a sculpture in the City right-of-way at 311 Main Street, as requested by the Cedar Falls Public Art Committee and the Art & Culture Board.   Interesting!  We didn't buy the sculpture on display at 311 main, we're just leasing it for $750 annually.  We have the right of first purchase. Reading the terms, it doesn't look like "rent-to-own" so I'd like to know at what point it would be more financially practical to purchase the piece outright, rather than paying the artist each year into perpetuity.  I'll ask.
  g. Resolution approving and authorizing execution of a Memorandum of Understanding with the Teamsters Union, Local No. 238 relative to earning compensatory time.   This allows police training officers to 96 hours of comp time until 6/30/19. I need to learn more about how this works, but no specific concerns at this time.
  h. Resolution approving and accepting a Partial Release of Real Estate Mortgage, a Warranty Deed and a Temporary Easement, in conjunction with the Center Street Recreational Trail Project.   This provides the city with access to private property, which will be needed for building the Center Street Rec Trail. No concerns.
  i. Resolution approving and authorizing execution of one Owner Purchase Agreement and two Tenant Purchase Agreements, and approving and accepting one Owner's Temporary Grading Easement for Construction, in conjunction with the West 1st Street Reconstruction Project.   To reconstruct 1st Street, the city requests a temporary easement at Jones Law Firm's property for about $4.4K.  My only concern is that the agenda description doesn't seem to match what the documents are actually about.  I'll ask.
  j. Resolution approving and adopting payment standards for the City's Section 8 Rental Assistance Program, to become effective November 1, 2018.   Sets a new payment standard for helping low income residents with housing costs. No concerns.  Bonus points for a very helpful chart!
  k. Resolution approving and authorizing execution of a Letter of Agreement for asbestos testing and clearance monitoring services with Hawkeye Environmental relative to the Northern Cedar Falls Flood Buyout Program.   2703 Timothy Street is expected to be purchased by the city as part of the flood buyout. This allows us to have it tested for asbestos prior to demo. No concerns.

J. Executive Session to discuss Property Acquisition per Iowa Code Section 21.5(1)(j) to discuss the purchase or sale of particular real estate only where premature disclosure could be reasonably expected to increase the price the governmental body would have to pay for that property or reduce the price the governmental body would receive for that property, following Public Forum.    
K. Public Forum. (Speakers will have one opportunity to speak for up to 5 minutes on topics germane to City business.)
